BeDigitalWorks ("we," "us," or "our") operates the bedigitalworks.com website and its business plan software (the "Service"). By using our Service, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Use of the Service

You may use our Service to create business plans, provided you:

• Are at least 18 years old.
• Provide accurate and complete information when using the Service.
• Do not use the Service for any illegal or unauthorized purpose.
• Do not attempt to interfere with the Service's functionality, including through hacking or introducing malicious code.

We reserve the right to suspend or terminate your access to the Service if you violate these Terms.

2. Intellectual Property

The Service and its content, including templates, designs, and AI-generated outputs, are owned by BeDigitalWorks and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

Any business plans or data you create using the Service remain your intellectual property. We will not use your business ideas or data to develop businesses ourselves.

3. Payments and Subscriptions

• Pricing: Our pricing is outlined on the Service (e.g., Starter Plan at $19, Pro Plan at $49, Enterprise Plan with custom pricing).
• Payment Terms: You agree to pay all fees associated with your chosen plan. Payments are non-refundable except as required by law.
• Subscription Duration: Your subscription lasts until you've used all the attempts included in your chosen plan (e.g., 5 business plans for the Starter Plan, 20 for the Pro Plan). You can manage or cancel your subscription at any time through our support email.

4. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Ensuring your use of the Service complies with applicable laws.

5. Limitation of Liability

To the fullest extent permitted by law, BeDigitalWorks is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of profits, data, or business opportunities. Our total liability to you will not exceed the amount you paid for the Service in the past 12 months.

The Service is provided "as is," and we do not guarantee that it will be error-free or uninterrupted.

6. Termination

We may terminate or suspend your access to the Service at our discretion, with or without notice, for reasons including violation of these Terms or inactivity. Upon termination, your right to use the Service will cease, but these Terms will continue to apply to prior use.

We may update these Terms from time to time. We will notify you of changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes your acceptance of the updated Terms.

8. Refund Policy

We aim to deliver high-quality business plans, but if our Service doesn't meet your expectations, you may request a refund under the following terms:

• Refund Request: Submit a Word document detailing at least 5 sections of your business plan that were unsatisfactory, with comments explaining why each section didn't meet your needs or was irrelevant to your industry..
• Evaluation: Our team will review your submission. To qualify for a refund, your concerns must be valid and well-explained.
• Partial Refund: If we identify at least 3 valid issues, you may receive a 50% refund of your payment.
• Full Refund: A full refund may be granted if the business plan significantly fails to meet your specified requirements, subject to a thorough review.
• Processing: Approved refunds will be processed within 5-10 business days and credited to your original payment method.
• Feedback: We welcome additional feedback to help us improve our Service.
